The exhibit pictured here is a silhouette created by White Watson of himself. This is explained in the article. The picture is well out of copyright at Watson died in 1835. The QR Code is public domain by definition and surely the phone company would not claim that is viewing software was copyright? I will add this rationale to the commons file.
